Memo: Data Breach Requirements Effective March 13, 2024

New notification rules awaiting OMB approval.

The Federal Communications Commission’s (FCC) Report and Order in WC Docket No. 22-21 has been published in the Federal Register. With this, new data breach requirements take effect March 13, 2024. The new notification requirement, however, has a delayed effective date until approval by the Office of Management and Budget (OMB).

The FCC modified the data breach notification rules to better ensure providers of telecommunications, interconnected Voice over Internet Protocol (VoIP), and Telecommunications Relay Services (TRS) are held accountable in their obligations to safeguard sensitive customer information and to provide customers with the tools needed to protect themselves if their data is compromised.
